1. Introduction and Agreement
Welcome to Thrive Telepsychiatry. These Terms and Conditions (“Terms”) govern your access to and use of the website located at thrivetelepsych.com (the “Website”) and the online psychiatric medication management services provided through our platform (collectively, the “Services”).
Thrive Telepsychiatry (“we,” “our,” or “us”) provides psychiatric medication management services through telehealth. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to access or use our Services.
In these Terms, the terms “you,” “your,” and “Client” refer to you as the user of the Services, including any dependents on whose behalf you are accessing the Services, and your heirs, assigns, and successors.
2. Description of Services
Thrive Telepsychiatry is an online psychiatric medication management service. We connect you with licensed healthcare providers (“Providers”) who specialize in prescribing and managing psychiatric medications via telehealth.
What We Offer
Our Services focus on psychiatric medication management, which includes:
- Initial consultations to evaluate whether psychiatric medication may be appropriate for you
- Prescribing psychiatric medications when clinically appropriate
- Medication refills for ongoing prescriptions
- Follow-up appointments to monitor medication effectiveness and side effects
- Dosage adjustments as needed based on your response to treatment
What We Do Not Offer
Our Services are limited to psychiatric medication management. We do not provide:
- Psychotherapy, counseling, or talk therapy
- Comprehensive psychiatric evaluations for complex diagnoses
- Emergency or crisis mental health services
- Treatment for substance use disorders
- In-person medical examinations
- Primary care or general medical services
If you require services beyond medication management, our Providers may refer you to appropriate healthcare professionals in your area.
3. State Licensing and Geographic Limitations
IMPORTANT: Our Providers are licensed to practice in specific U.S. states only. Due to state healthcare licensing laws, we can only provide Services to Clients who are physically located in a state where our Providers are licensed at the time of each appointment.
Licensed States
We currently provide Services in the following states: Maryland. Please check our Website for the most current list of states where we are licensed to provide Services, as this may change over time.
Your Location Requirements
By using our Services, you represent and warrant that:
- You are physically located in a state where we are licensed to provide Services at the time of each telehealth appointment
- You will accurately disclose your physical location before and during each appointment
- You understand that we cannot provide Services if you are physically located outside of our licensed states, even if you are a resident of a licensed state
If you travel outside of our licensed states, you must notify us and we will be unable to provide Services, including prescription refills, until you return to a licensed state. We are not responsible for any gaps in your care or medication access that result from your travel or relocation to states where we are not licensed.
Why This Matters
Healthcare providers are required by law to be licensed in each state where they provide care. Practicing medicine across state lines without proper licensure is illegal and can result in serious consequences for both providers and clients. These requirements exist to protect your safety and ensure you receive care that meets your state’s standards.
4. Not for Emergencies
OUR SERVICES ARE NOT INTENDED FOR USE IN MEDICAL OR MENTAL HEALTH EMERGENCIES. If you believe you or someone else is experiencing an emergency, including but not limited to suicidal thoughts, self-harm, psychosis, or any condition requiring immediate medical attention:
- Call 911 immediately
- Go to your nearest emergency room
- Call or text the 988 Suicide & Crisis Lifeline
Our Services are designed for ongoing medication management, not acute care. Our Providers do not have the ability to respond immediately to emergencies and cannot dispatch emergency services.
5. Telehealth Services and Informed Consent
Our Services are delivered exclusively through telehealth, which means healthcare services provided via electronic communications, video conferencing, and other technology when you and the Provider are not in the same physical location.
Benefits and Risks of Telehealth
Telehealth offers benefits such as increased access to care, convenience, and the ability to receive services from home. However, there are also limitations, including technical difficulties that may interrupt service, the inability to perform physical examinations, and the possibility that telehealth may not be appropriate for all conditions or all clients.
Before receiving Services, you will be required to review and consent to our Telehealth Informed Consent, which provides detailed information about the risks, benefits, and limitations of telehealth services.
Technology Requirements
To use our Services, you must have access to a device with a camera and microphone (such as a computer, smartphone, or tablet), a reliable internet connection, and a private location where you can speak confidentially with your Provider. You are responsible for ensuring your technology meets these requirements.
6. About Our Providers
Our Providers are licensed healthcare professionals who are authorized to prescribe psychiatric medications in their licensed states. Providers may include psychiatric nurse practitioners, physician assistants, or other qualified mental health prescribers as permitted by applicable state law.
All clinical decisions regarding your care, including whether to prescribe medication, what medication to prescribe, and dosage levels, are made by your Provider based on their independent professional clinical judgment. Thrive Telepsychiatry does not direct or control the clinical decisions of Providers.
Your Provider may determine that our Services are not appropriate for you and may decline to prescribe medication or may refer you to other healthcare resources. Not all clients who use our Services will receive a prescription.
7. Medications and Prescribing
Medications We May Prescribe
Our Providers may prescribe psychiatric medications including, but not limited to, antidepressants, anti-anxiety medications, mood stabilizers, and other medications as clinically appropriate. The specific medications available may vary by state and Provider.
Medications We Do Not Prescribe
Due to federal and state regulations regarding telehealth prescribing, our Providers may not prescribe certain controlled substances or other high-risk medications. These limitations may include but are not limited to:
- Certain Schedule II controlled substances
- Medications for opioid use disorder (such as Suboxone or methadone)
- Weight loss medications
- Other medications as restricted by applicable law or clinical policy
Please contact us for specific information about which medications we can and cannot prescribe in your state.
Your Responsibilities
You agree to provide accurate and complete information about your medical history, current medications (including those prescribed by other providers), allergies, and any other information relevant to your care. Failure to disclose accurate information may result in serious health consequences and may affect our ability to provide Services to you.
You are responsible for picking up prescriptions from your pharmacy and taking medications as directed by your Provider. If you experience any adverse reactions or side effects, you should contact your Provider or seek appropriate medical care immediately.
8. Not an Insurance Product
Thrive Telepsychiatry is not an insurance provider and does not sell or offer any type of insurance product or coverage. Your payments for Services are not insurance premiums. These Terms do not constitute a contract for insurance under any applicable law. If you desire health insurance, you must purchase it separately.
9. Account Registration and Eligibility
To access the Services, you must create a personal user account (“Account”). You may only have one Account, and your Account is not transferable to another person.
Eligibility Requirements
To use our Services, you must:
- Be 18 years of age or older (or have parental/guardian consent if under 18 and permitted by applicable law)
- Be physically located in a state where we are licensed to provide Services
- Have access to the technology required for telehealth appointments
Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. You may not allow any other person to access or use your Account. Notify us immediately at info@thrivetelepsych.com if you suspect any unauthorized access to your Account.
You agree to provide true, accurate, current, and complete information when creating your Account and to maintain and promptly update this information. If you provide inaccurate information, we reserve the right to suspend or terminate your Account.
10. Payment Terms
Fees
You agree to pay all fees and charges associated with your use of the Services according to the fee schedule provided on our Website or communicated to you. Fees may include consultation fees, follow-up appointment fees, and any other charges for Services rendered.
Payment Methods
By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the payment method for Services rendered. You agree to maintain valid payment information in your Account.
Insurance
If you have health insurance that may cover all or a portion of the Services, you may provide your insurance information to us. By doing so, you authorize us to submit claims and bill for services on your behalf. You are responsible for any co-pays, coinsurance, deductibles, and any amounts not covered by your insurance.
Please check with your insurance provider to confirm coverage before your appointment. We cannot guarantee that your insurance will cover our Services.
11. Cancellation and No-Show Policy
We understand that circumstances may require you to cancel or reschedule an appointment. Please provide at least 24 hours advance notice if you need to cancel or reschedule.
No-Show and Late Cancellation Fees: Appointments canceled with less than 24 hours notice or missed without notice may be subject to a cancellation or no-show fee. This fee is your responsibility and is typically not covered by insurance.

12. Acceptable Use Policy
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates any applicable federal, state, local, or international law or regulation
- Provide false, inaccurate, or misleading information, including about your identity, medical history, or physical location
- Attempt to obtain prescriptions for someone other than yourself
- Engage in any conduct that is abusive, threatening, harassing, or harmful to our staff or Providers
- Attempt to gain unauthorized access to our systems or networks
- Record appointments or use any artificial intelligence tool for transcription without prior explicit authorization
We reserve the right to suspend or terminate your access to the Services for any violation of this Acceptable Use Policy.
13. Intellectual Property
The Website and all content, features, and functionality are owned by Thrive Telepsychiatry or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Services for personal, non-commercial use in accordance with these Terms.
14. Privacy and HIPAA Compliance
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose your personal information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
We are committed to protecting your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA). Please review our Notice of Privacy Practices, which describes how we may use and disclose your protected health information and your rights regarding that information.
15. Disclaimer of Warranties
THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not warrant that any particular medication will be appropriate or effective for you. Your Provider will make treatment recommendations based on their professional clinical judgment.
The information provided through the Services is for informational purposes and is not a substitute for in-person medical care when such care is needed.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVE TELEPSYCHIATRY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless Thrive Telepsychiatry and its officers, directors, employees, agents, and Providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any false or misleading information you provide.
18. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Binding Arbitration
You and Thrive Telepsychiatry agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration shall be administered by JAMS (Judicial Arbitration and Mediation Services) pursuant to its applicable rules, and conducted by a single neutral arbitrator. The arbitration shall be held in Baltimore, Maryland, or at another mutually agreed location.
Class Action Waiver
YOU AND THRIVE TELEPSYCHIATRY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, you and we each waive any right to a jury trial.
Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to info@thrivetelepsych.com within 30 days of first accepting these Terms. If you opt out, you and Thrive Telepsychiatry will not be bound by this arbitration provision.
19. Termination
You may terminate your Account and these Terms at any time by contacting us at info@thrivetelepsych.com.
We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms, providing false information, or for any other reason in our sole discretion. Upon termination, your right to use the Services will cease immediately.
Termination of your Account will not affect your obligations for amounts owed or the retention of your medical records as required by law.
20. Modifications to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our Website and updating the “Effective Date” above. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
21. Communications
By providing your contact information, you consent to receive communications from us, including by email, phone, text message, and other electronic means. These communications may include appointment reminders, prescription notifications, billing information, and other information about our Services.
You acknowledge that electronic communications are not completely secure and that there is an inherent risk that communications may be intercepted by unintended recipients.
22. Governing Law
These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles.
For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Maryland.
23. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, Notice of Privacy Practices, and Telehealth Informed Consent, constitute the entire agreement between you and Thrive Telepsychiatry regarding your use of the Services.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
